TITO's Tokyo Walking Tours CUSTOMER TERMS AND CONDITIONS

In order to use the services provided by TITO's Tokyo Walking Tours, you must read and agree to our terms and conditions, written here. Using the Site constitutes an agreement to all terms and conditions warrants that you understand, agree to and accept all. This Agreement explains how you purchase tours and specifically limits the liability of TITO's Tokyo Walking Tours. 

 

TITO's Tokyo Walking Tours and the TITO's Tokyo Walking Tours guide(s) assume no responsibility for any illnesses, theft, injuries, lost items, accidents or any other damages incurred by the guests that may occur during the tour or his/her time in Japan. You accept complete and total responsibility for any damages, losses, theft, injuries, accidents or other damages that may be incurred upon you or other members of your tour while using the services of TITO's Tokyo Walking Tours. 

 

TITO's Tokyo Walking Tours may refuse or terminate services requested by you at any time for the following reasons, or for reasons not listed here.

 - TITO's Tokyo Walking Tours or the TITO's Tokyo Walking Tours guide has been provided with any kind of false information

   on the tour request form. You are responsible for providing accurate, timely and complete information in connection with

   your registration and use of the Site. TITO's Tokyo Walking Tours is not responsible for any claims relating to any inaccurate,

   untimely or incomplete information provided to us by you.

 - You attempt to profit from TITO's Tokyo Walking Tours by selling tours to others without our knowledge or consent.  

 - You request(s) to participate and/or engage in any kind of service directly or indirectly related to "sexual tourism." This

   includes, but is not limited to adult sexual goods/book stores, brothels and/or anything else that the TITO's Tokyo Walking

   Tours guide determines is inappropriate.

 - Any kind of inappropriate sexual behavior and/or advances perpetrated upon the guide or any other person on the tour,

   that he/she does not feel comfortable with.

 - Any kind of actions that the TITO's Tokyo Walking Tours guide or other persons on the tour, feels are offensive or

   inappropriate, such as unacceptable behavior in public, as well as any actions that may negatively reflect upon TITO's Tokyo

   Walking Tours.

 - The TITO's Tokyo Walking Tours guide may cancel appointments or guide requests with due notice because of unavoidable

   reasons and/or situations, extreme circumstances and/or natural disasters.

 

This Agreement is subject to change by TITO's Tokyo Walking Tours at any time.

 

You acknowledge that all travel involves an element of risk and that some tours offered on the Site may be riskier than others. You hereby assume all such risk and you, your estate, your family, heirs and assigns hereby release TITO's Tokyo Walking Tours and the Tour Guide from all claims and causes of action arising from any injury, death, or other damages, both monetary and non-monetary to you that may occur as a result of your participation in a TITO's Tokyo Walking Tours guided tour, the Site, or as custom made for you, or as a result of the negligence of any party, including the Tour Guide or any employee, officer, agent, contractor or assign of TITO's Tokyo Walking Tours.

 

We urge you to exercise caution if you purchase any goods during your tour. Neither TITO's Tokyo Walking Tours or the Tour Guide make any claims about the quality, source or other provenance of any goods which may be available for purchase.

 

TITO's Tokyo Walking Tours will never sell your information. TITO's Tokyo Walking Tours will use its best efforts to ensure the privacy of all other personal information, however we expressly disclaim any liability for any damage that may result should any information be released to any third parties. You hereby agree to hold TITO's Tokyo Walking Tours harmless for any damages that may result. 

 

 

TITO's Tokyo Walking Tours uses PayPal to process your credit card information, thus we have no access to your credit card information. For further information, please contact PayPal.

 

TITO's Tokyo Walking Tours reserves the right to make changes to this Agreement from time to time. TITO's Tokyo Walking Tours will notify you of any substantive and/or material changes to this Agreement or any policies posted on the Site by posting such changes on the Site.

 

This Agreement will become effective immediately upon your use of the Site and shall remain effective unless terminated by either party. TITO's Tokyo Walking Tours may terminate this Agreement immediately for any breach by you of this Agreement or any applicable policy of Tours Japan as outlined here and elsewhere on the TITO's Tokyo Walking Tours site.

 

You expressly agree that the use of this site is at your sole risk.  The site is provided on an "as is" basis without warranties of any kind, either express or implied.

 

Under no circumstances will TITO's Tokyo Walking Tours be liable to you for any indirect, incidental, consequential, special or exemplary damages arising from any provision of these Terms and Conditions or from the provision of any tours or other services arranged for from the Site. Furthermore, the TOTAL liability of Tours Japan arising with respect to this Agreement and the Site shall in no event exceed the total amounts paid by You to TITO's Tokyo Walking Tours under this Agreement.

 

For all disputes between TITO's Tokyo Walking Tours and you relating to the Site, this Agreement, transactions facilitated or conducted through the Site, tours and travel services ordered or purchased through the Site, dealings between You and TITO's Tokyo Walking Tours, or any related matters ("Disputes"), the parties will attempt to find the least onerous solution to the Dispute. If a Dispute cannot be resolved by the parties, then the Dispute must be resolved before the courts of Tokyo, Japan, and you hereby irrevocably submit to the exclusive jurisdiction of the courts of Tokyo, Japan, in respect of all Disputes. Proceedings regarding Disputes must be commenced in a court of competent jurisdiction in Tokyo, Japan, within six months after the Dispute arose. Any shorter time limit provided by statute or other law remains unaffected.

 

Failure by TITO's Tokyo Walking Tours enforce any provision(s) of this Agreement shall not be construed as a waiver of any provision or right. These Terms, and all other aspects of use of the Site, shall be governed by and construed in accordance with the laws of Japan.

 

These Terms and Conditions, constitute the entire agreement between you and TITO's Tokyo Walking Tours with respect to the Site. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall be enforced to the fullest extent possible, and the remaining Terms shall remain in full force and effect.

 

Nothing in this Agreement shall be construed as making either party the partner, joint venture, agent, legal representative, employer, contractor or employee of the other. Neither party shall have, or hold itself out to any third party as having, any authority to make any statements, representations or commitments of any kind, or to take any action, that shall be binding on the other, except as provided for herein or authorised in writing by the party to be bound.
